Are strata levies tax deductible?

Sometimes. Levies on a home you live in are generally private and not deductible. If the lot is rented or genuinely available for rent, regular administration and general maintenance contributions may be deductible in the year they are incurred. A levy for a specific capital improvement is generally not immediately deductible, though a capital works or depreciation claim may become available later.

General information only, not tax advice. Deductibility follows the use of the property and the purpose of the outgoing — not the name printed on the levy notice.

A deduction is generally available only to the extent an expense is incurred in producing assessable income. Private or domestic expenses and capital expenses are excluded from an immediate general deduction, although tax law may allow some capital costs to be claimed over time or recognised for capital gains tax purposes.

When are regular strata levies deductible?

ATO guidance treats regular payments to body corporate administration funds and general purpose sinking funds for ongoing administration and general maintenance as payments for services. For an eligible rental property, these payments can generally be claimed in the income year they are incurred. State labels vary, so an "administrative fund", "maintenance fund", "sinking fund" or "capital works fund" name does not settle the issue by itself.

Are special levies tax deductible?

A special levy is not automatically deductible or non-deductible. Its purpose is critical. ATO guidance specifically says that a special levy for a particular capital improvement is not deductible as an immediate rental expense, whether it is paid into a special purpose fund or raised as a special contribution to a general fund. A special levy used for genuine deductible repairs may require a different analysis.

An owner pays a A$12,000 special levy for a capital project. That is not automatically a A$12,000 deduction. If the eligible construction expenditure allocated to the lot is later established as A$10,000 and the applicable annual rate is 2.5%, a full-year capital works deduction could be A$250 after completion. Actual eligibility, allocation, timing and rates require project evidence and tax advice.

Which income year?

ATO guidance says eligible regular payments are claimed when incurred. That may not always be identical to the date money leaves the bank. Arrears, disputed liabilities, prepayments and instalment arrangements can change timing, so ask a registered tax agent to confirm the correct income year where the liability is not straightforward.

Record retention

ATO guidance generally requires rental income and expense records for five years from the relevant lodgment date. Keep capital works and CGT records for longer where they affect deductions or a later sale, and retain records while any related dispute remains unresolved.

Related questions

Can I deduct strata levies on the apartment I live in?
Generally no. Levies for a property used only as your home are private or domestic expenses. A different analysis may apply if part of the property genuinely produces assessable income.
Is a special levy deductible if it pays for repairs?
Possibly. Genuine repairs that restore function can be deductible, but initial repairs, entire replacements and improvements are treated as capital. Get the scope of works and invoices reviewed.
Can I claim the capital works fund contribution?
Not automatically. Regular contributions to a general purpose reserve may be deductible under ATO guidance, but money earmarked for a specified capital project generally requires capital treatment.
What if the property was vacant for part of the year?
Expenses may still be deductible while the lot is genuinely available for rent — evidenced by realistic rent, genuine advertising and no unreasonable conditions.
